Terms of service

These Terms of Service ("Terms") govern your use of the WhatPro Shopify application and website (collectively, the "Service"). By installing, accessing, or using the Service, you agree to these Terms.
1. The Service
WhatPro is a Shopify application that lets merchants send WhatsApp messages to their customers via the Meta WhatsApp Business Cloud API. We provide the application logic, admin UI, storefront blocks, and webhook handling. We do not provide the WhatsApp messaging itself — that is operated by Meta Platforms, Inc.
2. Eligibility
You must be (a) at least 18 years old, (b) the operator of a legitimate Shopify store, and (c) authorized to bind that store to this agreement. If you are using WhatPro on behalf of an organization, you represent that you have authority to do so.
3. Your account & responsibilities
You are responsible for the accuracy of every message template you configure and every variable you map to it.
You will not use WhatPro to send spam, illegal content, content that violates the WhatsApp Business Policy, or content that targets a person who has not opted in.
You will obtain proper opt-in consent from your customers before adding them to lists used by WhatPro.
You will not attempt to reverse-engineer the Service, circumvent rate limits, or impersonate another merchant.
You are responsible for all message and conversation fees Meta charges to your WhatsApp Business Account.
4. Pricing & billing
WhatPro plan fees are charged through Shopify's billing system on a recurring monthly basis.
Meta charges per-conversation fees directly to your WhatsApp Business Account. WhatPro does not collect or mark up these fees.
If you exceed the message cap on your plan in a billing period, additional messages may be queued, throttled, or blocked depending on your plan. We will warn you at 80% and 100% of the cap.
Upgrades take effect immediately and are pro-rated. Downgrades take effect at the next billing cycle.
Refunds are handled by Shopify per their App Store refund policy. We will support reasonable refund requests for service interruptions caused by us.
5. Acceptable use
You agree not to use the Service to:
Send unsolicited bulk marketing messages.
Promote illegal goods or services, or violate any applicable law (including but not limited to TCPA, CAN-SPAM, GDPR, ePrivacy, PDPL).
Impersonate Meta, WhatsApp, Shopify, or any third party.
Send messages outside the WhatsApp Business Policy categories (utility, authentication, marketing) for which the template was approved.
Process special-category personal data (health, religion, biometric) through the Service without specific written approval.
Violations may result in immediate suspension or termination of your account, and may also result in your WhatsApp Business Account being suspended by Meta independently.
6. Third-party services
The Service depends on Shopify and Meta. Their availability and pricing are not under our control. Outages or policy changes by Shopify or Meta may interrupt the Service. You agree we are not liable for such third-party-caused issues.
7. Service availability
We aim for 99.5% monthly uptime measured at the API level. We do not provide formal SLA credits at this stage. Maintenance windows are announced at least 24 hours in advance via email or in-app banner.
8. Data & privacy
The handling of personal data is governed by our Privacy Policy, which forms part of these Terms. Where you act as a data controller and we act as a processor (i.e. for your customers' data), the obligations of GDPR Article 28 are fulfilled by reference to that Policy.
9. Intellectual property
All software, design, content and trademarks associated with WhatPro remain the property of WhatPro and its licensors. You retain all rights to the content you create within the Service (template copy, customer lists, brand assets you upload). You grant us a limited license to process that content solely to deliver the Service.
10. Disclaimers
The Service is provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements.
11. Limitation of liability
To the maximum extent permitted by law, WhatPro's total aggregate liability arising out of or related to these Terms is limited to the greater of (a) USD 100 or (b) the amounts you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, lost revenue, or lost data.
12. Termination
You may terminate at any time by uninstalling the app from your Shopify store. We may suspend or terminate the Service immediately for material breach of these Terms, abusive use, or upon written notice for any reason with 30 days' notice. Upon termination, our data-retention rules in the Privacy Policy apply.
13. Changes to the Terms
We may modify these Terms by posting a new version. Material changes will be communicated via the email associated with your Shopify install at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of Cairo, Egypt, except that either party may seek injunctive relief in any court of competent jurisdiction.
